Roads and highways may have particular historic or scenic value to a community, region or state. Designating such roads as “scenic” or “historic” may have a significant impact on a developer’s ability to develop sites near or around or accessing these roads. Indeed, historic or scenic roadway designations often include provisions that limit development within, for example, “100 feet of a scenic byway.” Like the historic preservation idea, it is important to be aware of any such road or highway designation near a proposed Wal-Mart development. It also helps to ask local historians, preservationists and environmentalists whether a given area or roadway should be designated as scenic or historic so you can approach the local or state agency in charge of making such designations.
